Focus Groups

The term “focus group” refers to an informal discussion among a group of selected individuals about a particular subject or topic. When it comes to personal injury or medical malpractice cases, a focus group is an important component of pre-trial preparation in which a group of carefully selected people are asked about their impressions, attitudes, and beliefs about the case.

One of the most effective ways to prepare for trial or prepare for settlement negotiations is to present case facts to focus group jurors from the community where the case is pending. We utilize an experienced focus group moderator to present the case facts as favorably as possible toward the defense version of the case to insure that we receive feedback on the weaknesses and “soft spots” in the case. The moderator guides participants through a lively and candid discussion to uncover what facts and evidence focus group jurors believe are critical in deciding the outcome. We also use focus groups to present case themes, arguments, and analogies to see whether these arguments and strategies are persuasive with real jurors. The entire group discussion, including the focus group’s deliberations, is videotaped. The feedback we receive from focus groups is invaluable as we prepare for trial or mediation and settlement negotiations.
