Injured Construction Worker Sues Contractor

INDIANA CONSTRUCTION INJURY LAWSUIT

Dale Sunday, who was injured when a large lift truck toppled down an embankment behind a West Lafayette home April 30, is seeking monetary compensation for his pain and suffering, medical bills and lost wages. The suit accuses property owner Patrick Tharp and general contractor T.L. Kincaid Contracting Inc. of negligence by failing to create a safe work environment.

The lawsuit also alleges that the defendants failed to properly level out the land behind the unfinished home so the equipment they provided could maneuver safely behind the home being built in West Lafayette. Sunday and another man were riding in the lift being re-positioned by a third crew member when the accident occurred.
